PETALING JAVA: The High Court has dismissed an application by the World Triathlon Corporation (WTC) to stay proceedings of a claim filed by SRS Sports Centre Sdn Bhd.
SRS Sports in a statement Thursday said WTC wanted to stay the proceedings on the grounds that there was an "exclusive jurisdiction" clause in the agreement that the forum to resolve the dispute was in Florida, US.
It said the High Court ruled that Malaysia was the proper forum of convenience to hear the claim of SRS since the lronman Triathlon events were organised in Malaysia and the court was possessed with the jurisdiction to hear the matter.
SRS Sports is seeking damages for loss of rights to stage the lronman Triathlon and 70.3 Half lronman Triathlon in Malaysia.
The claim includes general damages, aggravated damages, punitive damages and other reliefs as the court deems fit.
SRS Sports was represented by Ranjan Chandran and Ganesh Magenthiran while WTC's counsel were Vimalan and Joyce Lim.
